Terms and Conditions of Membership

This Membership Agreement sets out the terms and conditions of membership of YMCA and incorporates the Club rules which are available on request. Membership is subject to these Terms and Conditions and at all times conditional upon the Member abiding by the club rules. Before committing to Membership, you should read carefully these Terms and Conditions and the Club Rules. 

We have made every effort to formulate the Membership Agreement in easily understandable language and to make the documentation as simple as possible. Should you, however, have any questions regarding the meaning or effect of any part of the membership documentation, you should please raise them with a member of staff. In signing this Membership Agreement, you are entering a legally binding contract. 

Membership

1. Administration and membership fees shall be fixed by the Club and may be altered at any time. Members will be notified (by notices posted on the Club notice boards) of any changes in the fees prior to the date of alteration. Subscription fees are payable by the means of a direct debit system offered by the Club. If in the first ten days of membership the Member is unhappy withthe service or facilities a full refund can be given.

2. All Membership applications must be made on forms provided by the club and the relevant fees paid at the time of joining. The Club reserves the right to reject an application for Membership or refuse admission.

3. Monthly payments shall be paid in advance by direct debit from the Member’s designated bank or building society account in instalments. Monthly instalments will fall due on the first day of the calendar month. If the Member joins the club during the course of a calendar month, the subscription for that month will be payable on a pro rata basis according to the number of days remaining during that month. Members joining after the 20th of the month maybe requested to pay an advanced Subscription payment in lieu of their direct debit payment. (These Memberships cannot commence until a direct debit has been completed and returned to the club if not applying on line).

4. Monthly payments must be paid regardless of how frequently the facilities are used. No freeze periods are permitted.

5. In the event that a direct debit collection fails to collect a monthly subscription, the club will ask for payment for that month over the counter. Failure to pay will result in entrance being denied and the arrears applied for by Direct Debit the following month. Subscription must be paid up to date before membership is reinstated. Any direct debit payment that fails to collect will result in a £5 administration charge being applied to the member’s account

6. Please ensure that you abide by the Club entry systems to all activities. A zero tolerance policy will be enforced for any infringement of entry regulations (Please refer to the Club Rules)

7. Memberships and cards are not transferable. Lost or stolen cards will be replaced and a fee will be charged. Misuse of cards by members will result in termination of membership.

Cancellation Policy

1. All memberships must run for a minimum period of three full months unless the ten day cancellation clause is activated. Notice of cancellation must be applied for by 23rd of the month otherwise payment for the following month will be applied for. No refunds will be given.

2. No refunds will be given for any memberships paid in advance.

3. Cancellation of membership is completed using an online form. It is the member’s responsibility to ensure that they receive this form via email from the club to be able to cancel their membership. Membership will be cancelled when; the club receives the completed form and the members is outside their contracted period. It is the member’s responsibility to ensure that confirmation of cancellation is received from the club. The YMCA cannot take responsibility for monies taken without proof of cancellation. No refunds will be given without proof of cancellation.

4. Membership can be cancelled after the initial contracted period. If this is completed before the 23rd of the month your membership will be cancelled for the following month.

5. Notification of direct debit cancellation will automatically result in the cancellation of the membership if the member is outside of their contract term. If the member has cancelled their direct debit incorrectly they may be subject to a re-joining fee or an administration charge.

Liability

YMCA’s liability for damage or loss to Member’s property is strictly limited to damage or loss suffered as a result of the negligence of Watford and District YMCA, its staff or its agents. YMCA will not accept any liability for any accident or injury (including any fatality) to any member, child, guest or visitor that may occur on the premises or within the grounds of the Club other than liability which may arise from the negligence of YMCA, its staff or its agents. All such incidents must immediately be reported in accordance with the Club Rules.

Rules and Regulations

1. The Member agrees to abide by the club rules.

2. YMCA may alter the Club Rules at any time. Alterations to the Club Rules will be posted on the Club Notice board, which will constitute due notice of all such changes. 

Data Protection

1. YMCA agrees to comply with its obligations under the Data Protection Act 1998 or any other relevant privacy or data protection laws(for instance, where applicable any implementing legislation of European Directive 95/46/EC on the protection of individuals with regard to the processing of personal data and on the free movement of such data).

2. Subject to YMCA receiving contrary notice from the member by his/her indicating as such in the box overleaf, YMCA may use the information provided by the member and any information relating to the members membership for the purpose of providing the member with details of any products and services which may be of interest to the member either by post, telephone or email for general business purposes and marketing.

3. From time to time YMCA may feel that the member would benefit from information relating to certain products or services offered by YMCA’s carefully selected partners. Subject to YMCA receiving contrary notice from the member by his/her indicating as such in the box overleaf, YMCA may disclose the information provided by the member to its selected partners for the purpose of direct marketing.

4. The member has the right at any time to notify YMCA that he/she wishes YMCA to cease using the member’s personal information for direct marketing purposes and YMCA will comply with any request to cease processing personal data for the purposes of direct marketing as soon as possible but in any event no later than forty (40) days from receipt of the member’s notification.

5. Members are entitled to a copy of the information YMCA hold about them by writing to YMCA and requesting it. YMCA reserves the right to charge members ten pounds (£10) for this service.

Force Majeure

Neither the member nor YMCA shall be deemed in breach of these terms and Conditions by reason of any delay in performing, or any failure to perform, any of the member’s or YMCA’s obligations in respect of these terms and conditions If the delay or failure was due to any cause beyond the Member’s or YMCA’s control including, but not limited to, acts of God, explosions, actual or suspected terrorist attacks, floods, fire or accident, war or threat of war, sabotage, civil disturbance, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority, import or export regulations or embargoes or industrial actions or trade disputes. In the event that any club is required to close all or part of it’s facilities as a result of general refurbishment work or damage, refunds will not be made available unless the closure is for more than 15 days.

Governing Law

This agreement shall be governed and construed in accordance with the laws of England and Wales and shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

Professional Membership

Our professional membership offer is available for new members only and the discounted rate will last for 12 months. Current members cannot uptake this membership or change their current price to the professional membership rate. 

Referral Offer

A Member who refers two people that take out a monthly membership each will receive a one month free membership that will be added to their account. Referred members must complete their minimum of three months of payments each before a one month free is added to the original members account.

Student Membership Offer

This membership is a no contract one month up front payment. Students must show a valid student ID to take out this membership. 

August 2017 Offer – August free

This is for new members only. When a new member signs up in August 2017 and a membership is taken out that commits them to the minimal of three months of paid membership we will provide August 2017 for free (August 2017 only). This means no payment for membership will be made until September 1st 2017 if the new member hits the above criteria.
